In a major victory for religious freedom, the United States Court of Appeals for the Second Circuit today issued a decision in two cases, Agudath Israel of America v. Cuomo and Roman Catholic Diocese of Brooklyn v. Cuomo, upholding challenges against New York State’s restrictions on attendance at houses of worship during COVID-19. The Court of Appeals ordered the federal district court to issue a preliminary injunction prohibiting the state from enforcing the 10 and 25 person attendance limits at houses of worship in the “red” and “orange” zones, respectively. It also ordered the district court to consider whether the 25% and 33% capacity restrictions in red and orange zones also violated the Free Exercise Clause of the First Amendment to the United States Constitution.

The governor said the state was investigating an incident of possible vaccination fraud, in a situation where a health care provider wasn’t following the priority population process. “Vaccines are valuable and there will be people who break the law and were looking at one health care provider who may have done that,” Gov. Cuomo said. “We want to send a clear signal to the providers that if you violate the law on these vaccinations, we will find out and you will be prosecuted.

The Second Circuit Court of Appeals just issued a ruling declaring that Governor Cuomo’s Executive Order restricting attendance at houses of worship “discriminates against religion on its face.” The United States Supreme had previously issued an injunction against the 10 and 25 person limitations imposed by Cuomo, pending the Agudah’s appeal. On December 18 — the last day of Chanukah – the Agudah’s appeal was heard by the Second Circuit Court of Appeals. The case challenged not only the 10 and 25 person limits but also the 25% and 33% capacity limitations as well. In a first-in-the-nation decision, the Court held that the 25% and 33% limitations on attendance at houses of worship are subject to strict scrutiny.

New York’s COVID hospitalizations have climbed above 7,000 and are now at their highest levels since May 10, as the State is poised to hit eclipse 30,000 confirmed COVID-19 deaths this week. The state has reported at least 100 new COVID deaths a day for nearly two weeks now. The total number of confirmed fatalities is now 29,511, though the CDC and experts say the virus is likely blamed for thousands upon thousands more deaths. Last Friday, the country topped the 19 million-case milestone and surpassed 332,000 virus deaths, according to a tally by NBC News. All in all, a virus that was just beginning to make global headlines this time last year has now claimed the lives of one in every 1,000 Americans.

BAY SHORE, NY — A Long Island man has been arrested after a Christmas morning crime spree that gave new meaning to the term doorbuster. It happened shortly before 2 a.m., Suffolk County police said, when Justin Shuffle stole a 2010 Bobcat skid loader, which is used to push snow, from a Bay Shore shopping center. He then crashed the mini-snow plow through the front doors of a nearby Target. Once inside, authorities said, Shuffle swiped a coat and several gift cards before police caught him in the electronics section of the big-box retailer. No one was injured, but the front doors of the store “suffered extensive damages,” police said in a news release. Shuffle, 33, of Deer Park, pleaded not guilty Friday to third-degree burglary and fourth-degree larceny.
